Terms and Conditions of Booking – The Midnight Fiddle Band

These Terms and Conditions govern the agreement between the Client (referred to herein as “you”) and The Midnight Fiddle Band (referred to herein as “we”, “us”, or “our”) for the provision of live music and related entertainment services for your event. By confirming your booking, you acknowledge that you have read, understood, and agreed to the following terms:

1. Performance Line-Up
​
The musicians shown in promotional materials are representative only and are not guaranteed for your booking, with the exception of the lead singer(s). The instrumentation you book will remain as agreed; however, individual musicians are selected from our roster of professional performers. All performers are vetted to meet the highest standards and reflect the band’s brand and image.
Should your chosen lead singer(s) become unavailable in extreme circumstances, you will be notified promptly and provided with materials (videos, images) of any proposed replacement(s). Should you decide to cancel the booking under these circumstances, no cancellation fee will apply, though any payments already made are non-refundable.

2. Audio and Visual Recording
​
No audio and/or visual recording or broadcast of the musicians’ performance is permitted without prior written consent.

3. Photography
​
You may include the musicians in your official photography provided your photographer grants permission to share all images of the musicians with us. If the photographer withholds such permission, they must refrain from photographing the musicians or their equipment. A supplementary photography and videography guideline will be provided and is deemed incorporated into this agreement.

4. Content Creation
​
We may bring professional content creators to capture photos and videos of the performance and general event ambiance. This content is used for promotional purposes and captured at no additional cost to you. We will not record ceremony performances and will ensure our content team is discreet and professional.
If you do not wish for any content to be captured, you must notify us in writing via email prior to the event. Otherwise, content creation may proceed at our discretion. Copies of content captured are available upon request.

5. Internet Access
​
We may require access to a stable internet connection for certain services (e.g. DJ provision). If this cannot be guaranteed, you must inform us in advance so we can make offline preparations. Without reliable internet, some services may be disrupted or unavailable. No refunds will be issued in such cases.

6. Electricity Supply
​
You must ensure a safe and reliable electricity supply is available and that musicians and their equipment are secure at the venue. Failure to provide appropriate power may result in cancellation or modification of the performance without refund.

7. Guest Conduct
​
You are responsible for ensuring that all guests treat our musicians with respect. Abusive, offensive, or unsafe behaviour will not be tolerated and includes, but is not limited to:

Physical intimidation or aggression

Derogatory or inappropriate language

Interference with musicians or equipment​
In the event of misconduct, we reserve the right to pause or terminate the performance for the safety of our team. You will be consulted before any such action is taken.

8. Event Timings
​
Musicians are booked for 1 hour prior to the provided start time, for the duration of the performance with up to 45 minutes’ break between sets and for the time it takes to pack down equipment immediately after the end of the performance (if you have provided an 8pm start time with 2 x 45 minute sets, the musicians are booked to play until 10:15pm). If there is a delay to the start time, musicians will be flexible for up to 30 minutes and then any further delay will be deducted from the performance time. Thus, the calculated end time will be extended for a maximum of 30 minutes. You should ensure your venue prioritise getting the musicians access to the performance area as quickly as possible. Set up and sound check is 1 hour in duration and this will not be shortened if the wedding is running late or the staff are delayed in clearing the performance area.

9. Cancellations and Postponements
​
Cancellation must be confirmed in writing. You acknowledge that a cancellation results in loss of potential work and revenue. Accordingly, all outstanding payments remain payable.
Postponement is considered cancellation unless agreed otherwise at our discretion. We may, without obligation, negotiate a postponement fee. If no agreement is reached, this contract remains in force.

10. Use of Equipment
​
Musicians’ instruments and equipment are not available for use by other persons unless agreed in writing beforehand. This restriction is non-negotiable on the day of the event due to insurance and safety policies.

11. Refreshments
​
Musicians attending for the full day must be provided with meals during the wedding breakfast and evening reception, along with free soft drinks throughout the day. Please inform your caterer or venue. We request that the daytime meal be served simultaneously with or prior to the guests’ meals to allow time for evening setup.

12. Outdoor Performances
​
Outdoor performances are at the discretion of the musicians and subject to safe, suitable conditions. Performances will not take place outside if weather conditions pose a risk, including but not limited to rain, excessive heat, cold, or wind. This decision is final and must be respected by the venue and client.
​
13. Travel Fees
​
A travel fee will be applied to venues over one hour’s travel time from SA10, which is included in your quote and due with the final payment.
14. Insurance
​
We hold Public Liability Insurance with a £10 million limit of indemnity. Certificates are available upon request. We are also insured for legal disputes through our Musicians’ Union membership.
​
15. Parking
​
Please ensure parking is reserved near the performance area to facilitate safe and efficient loading/unloading of equipment. Access through crowded areas must be avoided. Inform your venue in advance.

16. Modification of Agreement
​
No part of this agreement may be modified or cancelled except by mutual written consent, signed by both parties.
